Terms of Use - Times Astro Chatbot

Welcome to the Times Astro chatbot service made available by Times Internet Limited (“Company”, “TIL”, “we”, “us”, or “our”), including any associated websites, mobile/desktop applications, and messaging integrations operated by or on behalf of TIL (collectively, the “Platform”). These Terms of Use (the “Terms”) govern your access to and use of the Platform and the services offered thereon, including AI-generated astrological content and related features (the “Service”). By accessing or using the Platform or the Service, or by clicking “I Agree”, you agree to be bound by these Terms and our Privacy Policy (as amended from time to time).

Acceptance of Terms of Use

User Eligibility. “User”, “you”, or “your” means any person who accesses or uses the Platform/Service in any manner. You represent that you are 18 years of age or older and competent to enter into a binding agreement under Indian law. Individuals under 18 may access/use only under the supervision of a parent/legal guardian and through that guardian’s registered account.

Amendments. We may modify these Terms at our discretion by posting updated Terms on the Platform. Your continued use after changes are posted constitutes acceptance. Certain features may be subject to additional terms, which are incorporated by reference.

Service Changes. We may suspend, modify, or discontinue any channel, feature, content, or the Service (in whole or part) at any time without notice.

Important: If you do not agree to these Terms, you are not authorized to use the Platform or the Service.

Content Ownership and Limited License

Definitions.

• Content includes information, data, text, audio, music, sound, photos, graphics, video, software, prompts, outputs, messages, charts, reports, or other materials available via the Platform/Service.
• Company Content means content owned or controlled by TIL (including trademarks and logos), excluding Third-Party Content and User Submissions.
• Third-Party Content means content owned by third parties (including model providers, API partners, or community contributors).
• User Submissions means content you provide (e.g., birth details, questions, feedback, reviews).

Ownership. The Platform, Service, and Company Content are protected by applicable intellectual property laws. Except as expressly provided, TIL and its licensors own all rights therein.

License to You. Subject to these Terms, TIL grants you a personal, revocable, non-exclusive, non-transferable, limited license to access and use the Service for personal, non-commercial purposes. Any unauthorized use terminates this license.

Use Restrictions. You may not copy, modify, distribute, publicly perform/display, create derivative works from, or exploit the Platform/Service/Content except as permitted. Printing/downloading is allowed only for personal, non-commercial use. Systematic retrieval, scraping, database creation, and resale are prohibited.

Interactions. You are solely responsible for interactions with other users (if any features enable such interactions). Exercise caution and good judgment.

User Submissions & Licenses

By making any User Submissions, you grant TIL and its users a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, copy, adapt, modify, distribute, publicly display/perform, transmit, and otherwise exploit such User Submissions via the Platform/Service and in other media/technology now known or later developed, subject to applicable law and our Privacy Policy. You represent and warrant that you have all rights to grant such licenses and that your User Submissions do not infringe third-party rights or violate law. TIL may decline to publish or may remove any User Submissions at its discretion, including upon receiving complaints or government/legal notices.

Exchange of Information; Community/Chat Features

• You are solely responsible for what you post and must not submit defamatory, obscene, hateful, invasive, infringing, or otherwise unlawful/objectionable content.
• You must not upload viruses/malicious code or disrupt the Platform/Service.
• You acknowledge you may be exposed to content you find objectionable; TIL does not guarantee accuracy/integrity/quality of user-generated content.

Service Registration and Access

• Registration. You may need an account. Provide current, complete, and accurate information. Keep credentials confidential. Parents/guardians must prevent minors from accessing mature content.
• Retention. TIL may retain registration and transactional information as required by law.
• Single-User Access. Accounts are for individual use only. Credential sharing, caching for non-users, or multi-user access through one login is prohibited.
• Availability & Geography. Access may vary by region. You are responsible for Internet/data charges. The Platform is controlled from India; you are responsible for compliance with local laws if accessing from elsewhere.

Links to Other Sites

The Platform/Service may contain links to third-party sites/services. TIL does not control or endorse them and is not responsible for their content, practices, or policies. Review their terms and privacy policies before use.

Advertising Material

Parts of the Platform/Service may contain third-party advertising or promotional content. Responsibility for compliance with law lies with the advertiser. Your dealings with advertisers are solely between you and the advertiser.

Collection and Use of Personal Information

Please review our Privacy Policy (as available on or linked from the Platform). By using the Platform/Service, you consent to our collection, use, disclosure, and processing of information as described therein, including disclosures required by law and disclosures we deem necessary in connection with investigations of fraud, IP infringement, or unlawful activity.

Your Obligations

You agree to use the Platform/Service lawfully and to comply with applicable laws, including the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended. Without limitation, you agree not to:

• Circumvent content protections/digital rights management or geo-filters.
• Copy/download/stream-capture Content except as permitted.
• Interfere with Platform operations, conduct DoS/DDoS, or attempt unauthorized access.
• Use bots/spiders/offline readers to send excessive automated requests.
• Solicit login information, spam, or conduct commercial solicitations.
• Impersonate others or misrepresent your affiliation.
• Host/submit content violating the Prohibited Activities below.
• If you are a publisher of news/current affairs content, comply with the 2021 Rules and provide required details to the Ministry of I&B (TIL may display a verification mark for compliant publishers).

TIL may investigate and take appropriate legal/technical measures to prevent, stop, or deter violations, including cooperating with law enforcement.

Prohibited Activities

You agree not to host, display, upload, modify, publish, transmit, store, update, or share any information or User Submissions that:

• You do not own or have rights to;
• Are defamatory, obscene, pornographic, paedophilic, invasive of privacy, insulting/harassing on the basis of gender, libellous, racially/ethnically objectionable, encourage money laundering/gambling, or are otherwise unlawful;
• Harm children;
• Infringe IP or proprietary rights;
• Violate any applicable law;
• Mislead as to origin, or are patently false/misleading but presented as fact;
• Impersonate another person;
• Threaten India’s sovereignty/integrity/defence/security/public order or friendly relations with foreign states; incite cognizable offences; or insult other nations;
• Contain malware or code intended to interrupt, destroy, or limit functionality of any resource;
• Are intended to mislead/harass for financial gain or to cause injury;
• Threaten public health/safety; promote tobacco/alcohol/ENDS except as legally permitted; threaten critical information infrastructure; or otherwise contain objectionable content.

Unlawful content may be removed upon government/court notice or as required by law. TIL may preserve transmission records as required by law.

Termination; Suspension; Discontinuation

We may change, suspend, or discontinue the Service (in whole or part) at any time without notice. If you are a paid subscriber and we discontinue the Service not due to your breach, we may, at our discretion, offer a credit/refund/discount or other consideration. If your access is suspended/terminated for breach, you are not eligible for any consideration. We may retain records/content as required by law even after termination.

AI-Specific Disclaimers; Warranties and Liability

AI Outputs. The Service uses artificial intelligence and automated systems. Outputs may be incomplete, inaccurate, inappropriate, or inconsistent, and may not reflect current astrological practices or beliefs. Astrology is a matter of personal belief; interpretations vary. The Service is for information and entertainment purposes only and must not be relied upon for medical, legal, financial, psychological, or other professional advice, or for decisions that may have safety, health, or legal consequences. Always seek qualified professional advice where appropriate.

No Warranty. The Platform/Service are provided “as is”, “as available”, and “with all faults.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, timeliness, reliability, and availability. We do not warrant uninterrupted, error-free, or secure operation, or compatibility with your devices/software.

Limitation of Liability. To the maximum extent permitted by law, TIL and its affiliates/successors/assigns and their respective directors/officers/employees/agents/licensors/suppliers are not liable for any indirect, incidental, special, consequential, punitive damages or loss of profits/revenue/data arising from or related to your use or inability to use the Platform/Service, even if advised of the possibility. If any liability is found notwithstanding the foregoing, TIL’s aggregate liability shall not exceed the subscription charges paid by you for the month preceding the claim (if any).

Indemnification

You agree to indemnify, defend, and hold harmless TIL, its affiliates, successors, assigns, and their respective directors, officers, employees, agents, licensors, and suppliers from and against all losses, claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (i) your breach of these Terms; (ii) your use/misuse of the Platform/Service; (iii) your violation of law or third-party rights; or (iv) your User Submissions.

Notice of Copyright Infringement. To report alleged infringement, please send a notice containing: (a) authorized signatory’s physical/electronic signature; (b) identification of the copyrighted work; (c) identification/URL of allegedly infringing material; (d) contact details; (e) a good-faith statement of unauthorized use; and (f) a statement under penalty of perjury that the information is accurate and you are authorized to act.

General Terms

• Relationship. Nothing herein creates a partnership/agency.
• Assignment. You may not assign these Terms; TIL may assign/delegate without restriction.
• Force Majeure. Neither party is liable for delays/failures due to events beyond reasonable control (acts of God, war, civil commotion, epidemics, lockdowns, strikes, etc.).
• Law & Jurisdiction. These Terms are governed by the laws of India. Courts at New Delhi have exclusive jurisdiction.
• Time to Bring Claims. Any claim must be filed within one (1) year of accrual.
• Survival. Provisions that by nature should survive termination shall survive.
• Non-Waiver. No waiver is implied by failure to enforce.
• Entire Agreement. These Terms are the entire agreement and supersede prior understandings.
